Key takeaways
Online: 31 states and Washington, DC have licensed online sportsbooks taking bets as of October 12, 2026. Seventeen NBA teams play in those jurisdictions.
Retail only: eight states allow sports betting only in person. Wisconsin, home of the Bucks, is one of them until its tribal apps launch.
Not legal: 11 states have no legal sportsbook. Six of them, California, Texas, Georgia, Minnesota, Oklahoma and Utah, are home to 11 NBA teams.
Age: it’s 21 in most states and 18 in five jurisdictions. Kentucky raised its sports betting age from 18 to 21 in July 2026.
College rules: limits on betting in-state college teams or college player props don’t apply to NBA games or NBA player props.
Prediction markets: CFTC-regulated platforms operate in most states, including those with no sportsbook, but federal appeals courts have split on whether states can stop them.
Where NBA betting is legal in the US
Sports betting is legal in some form in 39 states and Washington, DC. In 31 states plus DC, a bettor can use a licensed online sportsbook while physically inside the state. Eight states allow betting only at a casino or another licensed location, and 11 don’t allow it at all.
A Celtics fan in Boston or a Knicks fan in New York can bet from a phone. A Thunder fan in Oklahoma City, a Mavericks fan in Dallas or a Lakers fan in Los Angeles doesn’t have a legal sportsbook at home. Prediction markets regulated by the Commodity Futures Trading Commission (CFTC) follow a separate map, set by federal law and by court cases still being decided.
NBA teams by state betting status
Of the 30 NBA teams, 29 play in the US. Seventeen are in states or DC with online sportsbooks: the Suns, Nuggets, Wizards, Heat, Magic, Bulls, Pacers, Pelicans, Celtics, Pistons, Knicks, Nets, Hornets, Cavaliers, Trail Blazers, 76ers and Grizzlies. The Bucks are in a retail-only state. The other 11 are in states with no legal sportsbook: the Lakers, Clippers, Warriors and Kings in California, the Mavericks, Rockets and Spurs in Texas, the Hawks in Georgia, the Timberwolves in Minnesota, the Thunder in Oklahoma and the Jazz in Utah. The Raptors play in Toronto, outside US betting law.
On opening night, October 20, Celtics at Pistons and 76ers at Knicks are home games in online states, while Thunder at Spurs is played in Texas, where no sportsbook is legal.

States with legal online sports betting
Most of the 31 online states license several sportsbooks. Florida’s only online sportsbook is Hard Rock Bet, run by the Seminole Tribe, and Delaware’s online betting runs through BetRivers. Missouri is the newest online market, launching on December 1, 2025. A legal bet depends on where you are when it goes in: apps check a phone’s location before every bet, so a Texan visiting New Orleans can bet on the Pelicans and a Louisiana resident can’t bet from a hotel in Houston. Our ranking of the best NBA betting apps covers the apps in these states.
States with retail-only sports betting
Eight states allow sports betting only in person: Mississippi, Montana, Nebraska, New Mexico, North Dakota, South Dakota, Washington and Wisconsin. New Mexico, North Dakota, Washington and Wisconsin allow it only at tribal casinos, and each tribe sets its own rules, including the minimum age. Gov. Tony Evers signed a law in April 2026 allowing statewide online betting in Wisconsin, run by the tribes. Each tribe must amend its gaming compact and clear a federal review first, and no app has launched as of October 12.
States where sports betting is not legal
Alabama, Alaska, California, Georgia, Hawaii, Idaho, Minnesota, Oklahoma, South Carolina, Texas and Utah have no legal sportsbook of any kind. Utah’s constitution doesn’t let the legislature authorize games of chance, so legal betting there would take a constitutional change. Prediction markets operate in most of these states because they’re overseen by the CFTC and argue that state gambling law doesn’t apply to them. FanDuel and DraftKings offer sports event contracts in several of them through FanDuel Predicts and DraftKings Predictions.
College betting limits don’t apply to the NBA
Many states restrict college betting. New Jersey and Connecticut bar most bets on in-state college teams, and Ohio, Maryland and Pennsylvania are among the states that ban college player props. These rules cover college games only. NBA spreads, totals and NBA player props are open in every state with legal sports betting, so a bettor in New Jersey can’t bet on Seton Hall but can bet on the Knicks or Nets.
How prediction markets fit into state betting law
A prediction market lists event contracts that pay $1 if an outcome happens and $0 if it doesn’t, on a platform the CFTC has designated as a contract market. Kalshi was designated in November 2020, and Ludlow Exchange, LLC, which operates as Novig, on June 16, 2026. These platforms argue that the Commodity Exchange Act gives the CFTC exclusive authority over their contracts. Many states say a contract on an NBA game is a sports bet that needs a state license.
Court fights by federal circuit as of October 12, 2026
Third Circuit (Delaware, New Jersey, Pennsylvania): sided with Kalshi on April 6, 2026. New Jersey has asked the Supreme Court to review the case (No. 26-299).
Ninth Circuit (Nevada and eight other Western states): sided with Nevada on August 28, 2026.
Sixth Circuit (Kentucky, Michigan, Ohio, Tennessee): sided with Ohio and Tennessee on September 25, 2026, holding that the Commodity Exchange Act doesn’t preempt either state’s gambling law.
Fourth Circuit (Maryland, North Carolina, South Carolina, Virginia, West Virginia): Kalshi’s appeal in Maryland was argued in May 2026 and hasn’t been decided.
State enforcement and where Novig is available
Connecticut issued cease-and-desist orders to nine platforms, Novig among them, in September 2026, and Missouri’s attorney general sent letters to six, including Novig, Kalshi and Polymarket. On October 2, the Ohio Casino Control Commission sent letters to 10 platforms, including Novig, asking each to stop offering sports event contracts in Ohio and confirm it in writing by October 16. Massachusetts and Michigan courts have barred Kalshi’s sports contracts, while a North Carolina law signed in July 2026 recognizes CFTC-registered prediction markets as lawful and taxes their fees starting January 1, 2027.
Novig’s help center lists it as available in every state except Arizona, Michigan and Nevada, based on where a user is located when trading, and requires users to be 21. That listing hadn’t changed as of October 12, after the letters from Connecticut, Missouri and Ohio.
Minimum betting age by state
The minimum age for sports betting is 21 in 31 states. Montana, New Hampshire, Rhode Island, Wyoming and Washington, DC set it at 18. In New Mexico, North Dakota, Washington and Wisconsin, each tribe sets the age. Kentucky had been at 18 until House Bill 904, which the legislature passed over Gov. Andy Beshear’s veto in April 2026, raised it to 21 in July. Prediction markets set their own minimums: Kalshi accepts users at 18, and Novig requires 21.
